1. ACCEPTANCE

By accessing and/or using the YouXxXTube website — including, but not limited to, all content, uploads, and user submissions available through youxxxtube.net (collectively, the "Website") — you agree to be bound by these Terms & Conditions and YouXxXTube's Privacy Policy (incorporated herein by reference), as well as all future amendments and modifications (collectively, the "Agreement").

If you do not agree to be bound by these Terms & Conditions, you must immediately cease use of youxxxtube.net.

YouXxXTube reserves the right to modify these Terms & Conditions at any time, at its sole discretion. Your continued use of the Website following any such modification constitutes your acceptance of the revised Agreement. If you do not accept the modified terms, you must stop using youxxxtube.net.

These Terms & Conditions apply to all users of the Website, whether registered ("member") or unregistered ("visitor"). You are only authorized to use youxxxtube.net if you agree to comply with all applicable laws and to be legally bound by this Agreement.

2. DESCRIPTION OF SERVICE

YouXxXTube is an online platform that enables users to upload, share, and view various types of adult content, including sexually explicit visual material. The Website also contains video content, information, and other materials posted or uploaded by its users. Your use of the Website and its content is subject to the terms of this Agreement.

The Website may contain links to third-party websites that are not owned or controlled by YouXxXTube. YouXxXTube assumes no responsibility for the content, privacy practices, or policies of any third-party websites, and cannot censor or edit third-party content. You acknowledge that YouXxXTube shall not be liable for any damages or losses arising from your use of any third-party website.

By using this Website, you affirm that you are at least eighteen (18) years of age and/or have reached the age of majority in your jurisdiction of residence. If the age of majority in your jurisdiction is greater than eighteen (18) years, you must have reached that higher age to use the Website.

4. CONDUCT

You acknowledge and agree that you are solely responsible for your own user submissions and for the consequences of posting, uploading, publishing, transmitting, or otherwise making them available on YouXxXTube.

You agree that you (and no one using your account) will not post, upload, publish, transmit, or otherwise make available on YouXxXTube any content that:

  • Is illegal, unlawful, harassing, harmful, threatening, tortious, abusive, defamatory, obscene, or libelous;
  • Invades any person's privacy, including personal information;
  • Is hateful or racially or ethnically offensive;
  • Contains viruses, malware, or any other malicious code designed to disrupt, damage, or monitor any software, hardware, or telecommunications systems;
  • Violates any applicable local, state, national, or international law or regulation, including laws relating to securities, privacy, and export control;
  • Depicts illegal activities, promotes physical harm or injury against any group or individual, or promotes cruelty to animals;
  • Exposes YouXxXTube to criminal or civil liability.

YouXxXTube reserves the right, at its sole and unfettered discretion, to determine what action shall be taken in response to any discovered or reported violation of this Agreement.

5. INTELLECTUAL PROPERTY

All content on the YouXxXTube Website — excluding user submissions — including but not limited to text, software, scripts, graphics, music, videos, photos, sounds, interactive features, trademarks, service marks, and logos, is owned by and/or licensed to YouXxXTube, and is protected by copyright and other intellectual property laws under United States, Canadian, and international law.

Content on the Website is provided for your personal, informational use only. It may not be used, copied, reproduced, distributed, transmitted, broadcast, sold, licensed, or otherwise exploited for any other purpose without the prior written consent of the respective rights holder. YouXxXTube reserves all rights not expressly granted herein.

You agree not to disable, circumvent, or otherwise interfere with any security features of the Website or any features that prevent or restrict the copying of content or enforce usage limitations.

6. USER SUBMISSIONS

YouXxXTube permits users to submit videos and other communications, and to host, share, and publish such user submissions. YouXxXTube does not guarantee confidentiality with respect to any user submission, whether or not it is published.

Linking & Embedding: YouXxXTube permits personal, non-commercial linking to materials on the Website. YouXxXTube also provides an "Embeddable Player" feature for use on personal, non-commercial websites, provided that a prominent link back to youxxxtube.net is included on any page containing the embedded player. You may not modify, build upon, or block any portion of the Embeddable Player. YouXxXTube reserves the right to discontinue any aspect of the Website, including the Embeddable Player, at any time.

Your Responsibilities: You are solely responsible for your user submissions and the consequences of posting or publishing them. By submitting content, you affirm, represent, and warrant that:

  • You own or have obtained all necessary licenses, rights, consents, and permissions to submit the content and to grant YouXxXTube the rights described in this Agreement;
  • You will not post, or allow anyone else to post, any material depicting any person under the age of 18 years, and you have inspected and maintain written documentation confirming that all persons depicted in your submissions are over the age of 18;
  • You have the written consent, release, and/or permission of every identifiable individual appearing in your submission to use their name or likeness as contemplated by this Agreement.

License Grant: You retain all ownership rights in your user submissions. By submitting content to YouXxXTube, you grant YouXxXTube a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your user submissions in connection with the YouXxXTube Website and its business — including for promotional and distribution purposes across any media format or channel. You also grant each user of the Website a non-exclusive license to access and use your user submissions as permitted by the Website's functionality and these Terms. This license terminates when you remove or delete the user submission from the Website.

In submitting material (video or other communication), you further agree that you shall not:

  • Submit material that is copyrighted, protected by trade secret, or subject to any third-party proprietary or privacy rights, unless you are the rights holder or have explicit permission to submit it and to grant the licenses described herein;
  • Publish false or misleading information that could damage YouXxXTube or any third party;
  • Submit material that is obscene, illegal, defamatory, libelous, harassing, hateful, or racially or ethnically offensive, or that encourages criminal conduct or civil liability;
  • Post advertisements or unsolicited commercial solicitations;
  • Impersonate any person or entity.

YouXxXTube does not endorse any user submission or any opinion, recommendation, or advice expressed therein, and expressly disclaims all liability in connection with user submissions.

YouXxXTube does not permit copyright infringement or violations of intellectual property rights. Content and user submissions will be removed upon proper notification of infringement. YouXxXTube reserves the right to remove content without prior notice and to terminate the access of any user found to be a repeat infringer.

While adult and pornographic content is permitted on the Website, YouXxXTube also reserves the right to determine, in its sole discretion, whether any content complies with these Terms for other types of violations, including but not limited to obscene or defamatory material. YouXxXTube may remove such content and/or terminate user access at any time without prior notice.

You acknowledge that your use of the Website may expose you to user submissions from various sources that may be inaccurate, offensive, indecent, or objectionable. You agree to waive any legal or equitable rights or remedies against YouXxXTube with respect to such content, and to indemnify and hold YouXxXTube, its owners, affiliates, operators, and licensors harmless to the fullest extent permitted by law.

YouXxXTube may, at its sole discretion, refuse to publish, remove, or block access to any user submission at any time, for any reason or no reason, with or without notice.

YouXxXTube provides the Website as a service to its users but assumes no responsibility for monitoring the Website for inappropriate content or conduct. If YouXxXTube elects to monitor the Website, it assumes no obligation to modify or remove inappropriate content and no responsibility for the conduct of any user. YouXxXTube may review and delete user submissions that, in its sole judgment, violate this Agreement or are otherwise offensive, illegal, or threatening to any person's safety (collectively "Inappropriate User Submissions"). You are solely responsible for the user submissions that you make visible on the Website or to any third-party website via an embedded player provided by the Website.

YouXxXTube may also repost or republish user submissions on other websites owned or controlled by YouXxXTube, or on partner websites under agreement, including sponsored or branded video content. YouXxXTube reserves the right to determine the criteria (such as rating, view count, or user reviews) by which user submissions may be shared with other websites.

7. ACCOUNT TERMINATION POLICY

A user's access to YouXxXTube will be terminated if the user is determined to be a repeat infringer of third-party rights. YouXxXTube also reserves the right to terminate user access for other violations of these Terms, including but not limited to submitting hate speech, obscene or defamatory material, or otherwise prohibited content, at any time and without prior notice, at its sole discretion.

8. ZERO TOLERANCE POLICY

YouXxXTube maintains a strict zero-tolerance policy toward illegal content. The following types of content are absolutely prohibited and will not be tolerated under any circumstances:

  • Child sexual abuse material (CSAM) or any content depicting minors in a sexual context;
  • Bestiality;
  • Rape or non-consensual acts;
  • Torture, snuff, or death-related content;
  • Any other obscene or illegal material.

YouXxXTube will fully cooperate with all relevant governmental and law enforcement agencies investigating the production or distribution of illegal content, including child pornography.

9. FEES

YouXxXTube reserves the right to introduce charges for certain services and to modify its fee structure at any time, at its sole discretion. If your access to the Website is terminated due to a breach of this Agreement, you will not be entitled to a refund of any unused portion of any subscription fees paid.

10. WARRANTIES & REPRESENTATIONS

You represent and warrant that all information you provide to YouXxXTube is accurate and current, and that you have all necessary rights, power, and authority to enter into this Agreement and to perform all obligations required of you hereunder.

As a condition of use, you agree to the terms of YouXxXTube's Privacy Policy. You acknowledge that the technical operation of the Website — including the transmission of your user submissions — may involve transmission over various networks and may require modifications to conform to technical requirements of connecting networks or devices. You further acknowledge that certain data collected by YouXxXTube may be disclosed in accordance with the YouXxXTube Privacy Policy.

11. WARRANTY DISCLAIMER

YOUR USE OF THE YOUXXXTUBE WEBSITE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOUXXXTUBE.NET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. YOUXXXTUBE MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THE WEBSITE OR ON ANY LINKED THIRD-PARTY SITE, AND ASSUMES NO LIABILITY FOR: ERRORS, MISTAKES, OR INACCURACIES IN CONTENT; PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE ARISING FROM YOUR USE OF THE WEBSITE; UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL OR FINANCIAL INFORMATION STORED THEREIN; INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE WEBSITE; BUGS, VIRUSES, TROJAN HORSES, OR SIMILAR MALICIOUS CODE TRANSMITTED BY THIRD PARTIES; OR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE USE OF CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE WEBSITE. YOUXXXTUBE DOES NOT WARRANT, ENDORSE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY THIRD PARTIES THROUGH THE WEBSITE. YOU SPECIFICALLY ACKNOWLEDGE THAT YOUXXXTUBE SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY, AND THAT ALL RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, YOUXXXTUBE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM: ERRORS, INACCURACIES, OR OMISSIONS IN ANY CONTENT; PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE; UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR ANY STORED PERSONAL OR FINANCIAL INFORMATION; INTERRUPTION OR CESSATION OF SERVICE; BUGS, VIRUSES, OR OTHER MALICIOUS CODE TRANSMITTED BY THIRD PARTIES; OR LOSS OR DAMAGE INCURRED AS A RESULT OF CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE WEBSITE. THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT (WARRANTY, CONTRACT, TORT, OR OTHERWISE), AND REGARDLESS OF WHETHER YOUXXXTUBE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU SPECIFICALLY ACKNOWLEDGE THAT YOUXXXTUBE SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless YouXxXTube, its parent company, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of and access to the YouXxXTube Website;
  • Your violation of any provision of these Terms & Conditions;
  • Your violation of any third-party right, including any copyright, property, or privacy right; or
  • Any claim that one of your user submissions caused damage to a third party.

This indemnification obligation survives the termination of this Agreement and your use of the YouXxXTube Website.

By using the Website, you affirm that you are either at least 18 years of age, an emancipated minor, or possess valid parental or guardian consent, and that you are fully able and competent to enter into, and comply with, all terms, obligations, representations, and warranties set forth in this Agreement.

14. ASSIGNMENT

Your rights and obligations under this Agreement may not be transferred or assigned by you without YouXxXTube's prior written consent. YouXxXTube may freely assign this Agreement and any rights or licenses granted hereunder without restriction.

If any term, clause, or provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or enforceability of the remaining terms, clauses, or provisions. The invalid or unenforceable provision shall be deemed severed from this Agreement, and the remaining provisions shall continue in full force and effect.
